Should a hostile witness be treated as criminal and a hindrance to justice?
A hostile witness should be treated as criminal and a hindrance to justice. Same should be the treatment for people filling false affidavits in courts. It should be made mandatory, without exception that if an affidavit is found furnishing false information the court hearing the case must forward it for a registration of a criminal complaint and direct agencies to prosecute the offender. Court must also fix a time frame for investigating agency to report back for prosecution of the false affidavit offender.
Yes in criminal matters perjury is a crime but in civil matters it depends on the court.
What got in your craw?
A hostile witness is not a criminal, just not cooperative. And that’s ok.
Perjury is another problem, and we have laws for that already.

Handbook of Organizational Justice $157.35 Matters of perceived fairness and justice run deep in the workplace. Workers are concerned about being treated fairly by their supervisors; managers generally are interested in treating their direct reports fairly; and everyone is concerned about what happens when these expectations are violated. This exciting new handbook covers the topic of organizational justice, defined as people’s perceptions of fairness in organizations. The "Handbook of Organizational Justice" is designed to be a complete, current, and comprehensive reference chronicling the current state of the organizational justice literature. Tracing the development of ideas regarding organizational justice, this book: *introduces the topic of organizational justice from a historical perspective and presents fundamental issues regarding the nature of organizational justice; *examines the justice judgment process, specifically addressing basic psychological processes, such as the roles of control, self-interest, morality, and trust in the formation of justice judgments; *discusses the consequences of fair and unfair treatment in the workplace; *focuses on such key issues as promoting justice in the workplace in ways that help manage stress, and the underlying processes that account for the effectiveness of justice applications; *examines the generalizability of the interaction between process and outcomes and focuses on the notion of cross-cultural differences in justice effects; and *summarizes the state of the science of organizational justice and presents various issues for future research and theorizing. This "Handbook" is useful as a guide for professors and graduate students, primarily in the fields of management and psychology. It also is highly relevant to professionals in the fields of communication, sociology, legal studies, marketing, and human resources management. |

Direct Action: An Ethnography $27.09 Anthropologist David Graeber undertakes the first detailed ethnographic study of the global justice movement. The case study at the center of "Direct Action" is the organizing and events that led to the one of the most dramatic and militant mass protests in recent years-against the Summit of the Americas in QuA(c)bec City. Written in a clear, accessible style (with a minimum of academic jargon), this study brings readers behind the scenes of a movement that has changed the terms of debate about world power relations. From informal conversations in coffee shops to large "spokescouncil" planning meetings and tear gas-drenched street actions, Graeber paints a vivid and fascinating picture. Along the way, he addresses matters of deep interest to anthropologists: meeting structure and process, language, symbolism and representation, the specific rituals of activist culture, and much more. Starting from the assumption that, when dealing with possibilities of global transformation and emerging political forms, a disinterested, "objective" perspective is impossible, Graeber writes as both scholar and activist. At the same time, his experiment in the application of ethnographic methods to important ongoing political events is a serious and unique contribution to the field of anthropology, as well as an inquiry into anthropology’s political implications. David Graeber is an anthropologist and activist who teaches at the University of London. Active in numerous direct-action political organizations, he has written for "Harper’s Magazine" and is the author of "Fragments of an Anarchist Anthropology," "Towards an Anthropological Theory of Value," and "Possibilities." |

Victims of Crime and Community Justice $29.95 Can a victim’s experience really be improved purely by diminishing the rights of offenders and increasing penalties for offending?. Writing at a time when the UK is beginning to accept that an offender-led criminal justice system cannot provide direct benefits to the victim of crime, Dr Brian Williams lays bare the assumptions about victims and offenders that currently restrict efficient policy-making. He evaluates proposed solutions, including restorative justice and informal community justice, and draws on evidence and experiences from the UK and around the world to investigate which measures have proved effective and how criminal justice policies might be redressed. This book provides a thorough and comprehensive analysis of the topic for students of criminology and victimology, and is essential reading for practitioners in social work and probation officers. |

The Japanese Way of Justice $95 Criminal proceedings in which people can lose life, liberty, or reputation tell us a great deal about the character of any society. In Japan, it is prosecutors who wield the greatest control over these values and who therefore reveal most clearly the character of the Japanese way of justice. In this book, David T. Johnson portrays Japanese prosecutors at work; the social, political, and legal contexts that enable and constrain their actions; and the content of the justice thereby delivered. Johnson is the first researcher, Japanese or foreign, to gain access to the frontline prosecutors who charge cases and the backstage prosecutors who manage and direct them. He shows that prosecutors in Japan frequently harmonize to imperlatives of justice that Americans often regard as irreconcilable: the need to individualize cases alike. However, their capacity to correct offenders and to obtain contrite, complete confessions from criminal suspects. Johnson argues that this extreme reliance on confessions occasionally leads to extreme efforts to extract them. Indeed, much of the most disturbing prosecutor behavior springs directly or indirectly from the system’s inordinate dependence on admissions of guilt. The major achievements of Japanese criminal justice are thus inextricably intertwined with its most notable defects, and efforts to fix the defects threaten to undermine the accomplishments. Clearly written and skillfully argued, this comparative analysis will be of interest to students of Japan, criminology, and law and society. It illuminates unexplored realms in Japan’s criminal justice system while challenging readers to examine their assumptions about how crime should be prosecuted in their own systems of criminal justice. |

Global Justice and Bioethics $45 Despite the massive scale of global inequalities, until recently few political philosophers or bioethicists addressed their ethical implications. Questions of justice were thought to be primarily internal to the nation state. Over the last decade or so, there has been an explosion of interest in the philosophical issues surrounding global justice. These issues are of direct relevance to bioethics. The links between poverty and health imply that we cannot separate questions of global health from questions about fair distribution of global resources and the institutions governing the world order. Similarly, as increasing numbers of medical trials are conducted in the developing world, researchers and their sponsors have to confront the special problems of doing research in an unjust world, with corresponding obligations to correct injustice and avoid exploitation. This book presents a collection of original essays by leading thinkers in political theory, philosophy, and bioethics. They address the key issues concerning global justice and bioethics from two perspectives. The first is ideal theory, which is concerned with the social institutions that would regulate a just world. What is the relationship between human rights and the provision of health care? How, if at all, should a global order distinguish between obligations to compatriots and others? The second perspective is from non-ideal theory, which governs how people should behave in the unjust world in which we actually find ourselves. What sort of medical care should actual researchers working in impoverished countries offer their subjects? What should NGOs do in the face of cultural practices with which they deem unethical? If coordinated international action will not happen, what ought individual states to do?These questions have more than theoretical interest; their answers are of direct practical import for policymakers, researchers, advocates, NGOs, scholars, and others. This book is the first collection to comprehensively address the intersection of global justice and bioethical dilemmas. |

The Access of Individuals to International Justice $49.58 This book contends that the right of access to justice (at national and international levels) constitutes a basic cornerstone of the international protection of human rights, and conforms a true right to the Law. It amounts, lato sensu, to the right to the realization of justice. In such understanding, it comprises not only the formal access to a tribunal or judge, but also respect for the guarantees of due process of law, the right to a fair trial, and to reparations (whenever they are due), and the faithful execution of judgments. On its part, the right to an effective domestic remedy is a basic pillar of the rule of law in a democratic society. In its part, the right of international individual petition, together with the safeguard of the integrity of international jurisdiction, constitute the basic foundations of the emancipation of the individual vis-a-vis his own State. This is a domain that has undergone a remarkable development in recent years. It is submitted that the right of access to justice belongs today to the domain of jus cogens. Without it, there is no legal system at all. The protection of the human person in the most adverse circumstances has evolved amongst considerations of ordre public. Such recent evolution has been contributing to the gradual expansion of the material content of jus cogens. Furthermore, the very notion of "victim" (encompassing direct, indirect and potential victims) has been the subject of a considerable international case-law. Victims have had their cause vindicated in situations of utmost adversity, if not defencelessness (e.g., abandoned or "street children," undocumented migrants, members of peace communities in situations of armed conflict, internally displaced persons, individuals in infra-human conditions of detention, surviving victims of massacres). |

Social Threat or Social Justice? $96.59 There is a wide range of sanctions used by the criminal justice system to punish criminal offenders including death, imprisonment and community supervision. All of these sanctions involve a social institution exerting direct social control over an individual either through loss of life or liberty or via constant supervision. And even after a prison sentence or community supervision term has ended there are continuing penalties, for while a prison term may be completed the label of convicted felon last a lifetime. A unique Florida law affords judges the discretion to withhold adjudication for felony offenders sentenced to probation. This sentencing option allows offenders to avoid the label of convicted felon and retain all rights normally lost upon felony conviction within the state of Florida, including the right to vote and carry fire arms. This book investigates the individual and social contingencies which impact the withholding of adjudication from a social threat and social control perspective. When Justice Prevails $3.94 C. Steven Yerrid became a trial lawyer to make a difference. In an impressive career that spans more than twenty-five years, he has done just that. In When Justice Prevails, Steve Yerrid presents eight of his most dramatic and challenging cases. Although they involve many different areas of the law – from the State of Florida’s landmark case against "Big Tobacco," to medical malpractice, personal injury, product liability, maritime catastrophe, and intellectual property law – they all share a common thread. Yerrid states, "Each one is a testament to the endurance of the human spirit. It is reflected in the victims’ ability to overcome personal tragedy and loss, as well as in the jurors’ struggle to find the truth and deliver a just verdict." A page-turning work of legal nonfiction, When Justice Prevails depicts in vivid detail the dramatic, often heartbreaking stories of Yerrid’s clients. Writing compellingly about his own thoughts as he decides to take on each case, Yerrid offers insight into how he builds and executes his legal strategies, from opening remarks to the verbatim presentations of his emotionally charged closing arguments. Rarely have readers been given such direct access to all the fascinating moments of real-life trials – the sparring of the lawyers, the testimony of the witnesses, the turning points of cross-examination, and the behind-the-scenes maneuverings of both Yerrid and his opponents. |

Atrocities and International Accountability: Beyond Transnational Justice $35.61 Rebuilding societies where conflict has occurred is rarely a simple process. Where conflict has been accompanied by gross and systematic violations of human rights, the procedure becomes very controversial. The traditional debate on "transitional justice" sought to balance justice, truth, accountability, peace, and stability. The appearance of impunity for past crimes undermines confidence in new democratic structures and casts doubt upon commitments to human rights. Yet the need to consolidate peace sometimes resulted in reluctance on the part of authorities –both local and international –to confront suspected perpetrators of human rights violations, especially when they are a part of a peace process. Experience in many regions of the world therefore suggested a tradeoff between peace and justice. But that is changing. There is a growing consensus that some forms of justice and accountability are integral to –rather than in tension with –peace and stability. This volume considers whether we are truly going beyond the transitional justice debate. It brings together eminent scholars and practitioners with direct experience in some of the most challenging cases of international justice, and illustrates that justice and accountability remain complex, but not mutually exclusive, ideals. |
